INDEPENDENT LEGAL ADVICE (ILA)
We always recommend that both parties obtain Independent Legal Advice or βILAβ after a separation. In order for a separation agreement to be durable and enforceable, both people signing an agreement should be fully informed of, and understand their legal rights and obligations. It is often helpful to obtain some preliminary legal advice before you attend mediation so you are prepared to make decisions. This is especially important in situations where parties devise an agreement that deviates from the legal model.
